Could Dior’s J’Adore bottle see its trademark approved in China?

Dior is hopeful that its long-running battle to secure a 3D trademark for its J’Adore bottle could soon be drawing to a favourable conclusion, according to a report published by the International Law Office.

The LVMH-owned brand has been turned down not once, not twice but four times since it first filed an application for international registration (with territorial extension to China) in November 2014. However, in April this year, the Supreme People’s Court announced a retrial ruling, overturning all four earlier decisions and ordering China’s Trademark Review and Adjudication Board (TRAB) to review the case.

The trial will re-examine whether the Christian 3D mark is inherently distinctive and the parameters of commonly used packaging.
